1. Acceptance of Terms
By accessing or using any services provided by WebGene.tech ("we", "us", or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services. We reserve the right to modify these terms at any time, and your continued use of our services constitutes acceptance of any changes.
2. Services
WebGene.tech provides web development, web design, SEO optimization, social media marketing, and UI template services. We reserve the right to modify, suspend, or discontinue any service at any time without prior notice. We will make reasonable efforts to notify clients of material changes that affect active engagements.
3. Client Responsibilities
Clients are responsible for providing accurate project requirements, timely feedback, and any necessary content, credentials, or third-party assets required to complete the project. Delays caused by the client may affect project timelines and deliverables. Clients must ensure they have the legal right to use any content, images, or materials they provide to us.
4. Intellectual Property
Upon receipt of full payment, clients receive ownership of the final deliverables produced specifically for them. WebGene.tech retains ownership of all pre-existing tools, frameworks, templates, and code libraries used in the development process. We reserve the right to showcase completed work in our portfolio unless explicitly agreed otherwise in writing.
5. Payment Terms
Payment terms are outlined in the individual project agreement or invoice. A deposit may be required before work begins. Remaining balances are due upon project completion or as specified in the project contract. Late payments may incur additional charges. We reserve the right to suspend work or withhold deliverables until outstanding payments are settled.
6. Confidentiality
We treat all client information, business data, and project details as confidential. We will not share, sell, or disclose this information to third parties without your explicit consent, except as required by law. This obligation continues after the completion of any project engagement.
7. Limitation of Liability
WebGene.tech shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to our services, including but not limited to loss of revenue, loss of data, or business interruption. Our total liability to any client shall not exceed the total amount paid for the specific service giving rise to the claim.
8. Warranties and Disclaimers
We deliver services with reasonable skill and care and in accordance with the agreed specifications. However, we do not guarantee specific outcomes such as search engine rankings, traffic volumes, or revenue increases. All third-party integrations, platforms, and tools are subject to their own terms and conditions, and we are not responsible for changes or outages in third-party services.
9. Termination
Either party may terminate a project engagement with written notice. Upon termination, the client is responsible for payment for all work completed up to the termination date. We will provide all completed deliverables upon receipt of final payment. Termination does not affect any rights or obligations that arose prior to termination.
10. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Uttar Pradesh, India. We will attempt to resolve disputes amicably before resorting to legal proceedings.
